1. Subject Matter of the Contract and Legal Acceptance

1.1. Subject of the Contract:These Terms and Conditions of Service (hereinafter “T&C”) govern the acquisition and provision of architectural rendering and visualization services offered by [Company Name or LLC], hereinafter “The Company”, through its online platform. 1.2.Acceptance and Legal Nature:The purchase of any plan or service and thecheck-outon the platform constitutes theunconditional acceptance of these T&Csserving as aLegal Contract for the Provision of Digital Servicesbinding agreement between the Client and the Company.

2. Prices, Project Scope and Currency

2.1. Base Currency:All published prices for international customers are denominated inUS Dollars (USD). 2.2. Clients in Colombia:The Company will apply a specific price list for transactions carried out in Colombia, denominated inColombian Pesos (COP). 2.3. Paid:The service is fromsingle payment and per project, and does not constitute a recurring subscription. 2.4.Standard Scope:The plan values ​​apply tostandard properties up to 200 m² (approx. 2,152.78 ft²)If the Client’s project exceeds this size, they should visit the “Customized” section or contact the Company to receive advice and a quote tailored to their needs.

3. Service Process and Execution

3.1. Accepted Client Files:The Client is responsible for providing the necessary source information. The Company accepts basic files, including, but not limited to:.cad, .skp, .fbx, .pdf, .png, .jpeg, containing measurements, plans, and references. The Company will create the 3D model from this information. 3.2.Implementation Period:The standard delivery time for the service is2 calendar monthsfrom the confirmation of payment and receipt of theall required files and databy the Client. 3.3.Warranty and Reviews:Each plan purchased includes a specific number of review rounds and deliverables. The exact details of the reviews and the quantity ofrendersor videos are specified in the description of each plan. 3.4.Major Modifications:It will be considered amajor modification(subject to additional cost) any changes requested by the Client thatexceed the number of revisions or the scopespecified in the purchased service plan.

4. Intellectual Property and Promotional Use (Mandatory Clause)

4.1. Ownership of the Final Render:After final delivery and full payment, the Client acquires the commercial use rights over therender the final video(the image/visualization) for their own promotion or project. 4.2.3D File Ownership Source: He 3D working filecreated by The Company to generate the rendernot included4.3.Promotional Use License:By accepting these T&Cs, the Customer grants the Company aworldwide, non-exclusive, royalty-free and irrevocable licenseto use the service-related material, including, but not limited to:The final render, the final video, images of the modeling process, and fragments of the project in developmentThis use is intended for the promotion and advertising of the Company on any digital medium (e.g., Reels, TikTok, web portfolio).reserves the right to make use or notof said material. 4.4.Confidentiality Notice:If the Client needs to postpone the publication of the rendering for confidentiality reasons, they must notify the Company in writing before work begins. The maximum period for postponing publication will be1 monthfrom the final delivery date.

5. Storing and Deleting Files

5.1. Storage Period:The original source files provided by the Client and the final render files delivered by the Company will remain accessible on our cloud server for a period of60 days5.2.Elimination:After the 60-day period has elapsed, the Company will proceed topermanent removalof all project files, without the Client having the right to subsequent claim for the loss of said files.

6. Warranty and Refund Policy

6.1. Conditional Refunds: No refunds will be issued.Under no circumstances, except in the following cases: a) The Company exceeds the delivery time stipulated in the plan (2 calendar months), without justification of force majeure or delay on the part of the Client. b) The final files delivered contain defects offundamental technical quality(e.g., excessive noise, file corruption) that prevent its use as stipulated in the purchased plan. 6.2.Warranty Period:The Client has a period of15 calendar daysFrom the final delivery date, to formally notify support of any breach of the above conditions (6.1.a and 6.1.b) in order to make the warranty effective. 6.3.Project Abandonment by the Client:If the Client pays for the service but does not provide the files or information necessary to start or continue the work within a period of30 daysIf a refund is requested after the payment date, the Company will return the money, less any administrative or management costs incurred. If a refund is not requested within that timeframe, the amount paid will be considered a credit toward a future service.
